Terms of Use

These Terms of Use (“Terms”, “Agreement”) set out the terms and conditions under which individuals and organisations may use the DomestaSafe website and/or services (together, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific features (together, the “DomestaSafe Policies”), whether or not you create an account.

If you do not agree with these Terms or any DomestaSafe Policies, you must not use the Platform.

Definitions

For the purposes of these Terms:

• “DomestaSafe”, “we”, “us”, “our” means DomestaSafe, a company operated by CheckMinistry.
• “Site” or “Platform” means www.domestasafe.com.
• “Services” means the background check services offered through the Site, including checks for domestic helpers, legally permitted verification activities carried out with valid consent, status tracking and reporting for requests, and automated notifications to update Users, request documents, and enable Domestic Helpers to submit required information.
• “User”, “you”, “agent”, or “Employer” means any individual, household, business, authorised representative, hiring agent, or entity that accesses or uses the Platform for the purpose of requesting background check services for a domestic helper.
• “Domestic Helper” means any individual who is the subject of a background check request and who provides domestic or household services. This includes, without limitation, Domestic Worker(s), Domestic Helper(s), Foreign Domestic Helper(s), and Migrant Domestic Worker(s), regardless of the terminology used in different jurisdictions.

  • Personal Assistant
  • And other domestic helper categories that may be added in the future
• “Registered User” means a User who has successfully created an account on the Platform to access DomestaSafe’s background check services.

Description of Services (Background Check)

About Our Services

“Services” means the background check services offered through the Site by DomestaSafe, including, but not limited to:

• Background check of domestic helpers, currently focused on Housekeeper support roles, with additional domestic helper categories to be added in the future.
• Background check services, strictly subject to legal permissibility and the valid, informed consent of the individual being checked, which may include only the following:
  • Criminal record checks
  • Civil litigation checks
  • Credit checks
• Background check services must be requested and paid for by the User (Employer or Agent).
• Digital status tracking, reporting, and background check updates, allowing:
  • For Users (Requesting Parties/Employers)
    • Account creation and activation status
    • Service purchase and background check request submissions
    • Ongoing request progress updates
    • Final report availability and download status
  • For Domestic Helpers (Background Check Subjects Only):
    • Upload consent forms
    • Upload only the documents requested for the background check
• Automated notifications and communications through email, phone calls, and WhatsApp, which may be used to:
  • Keep Users informed of background check progress and final results
  • Request documents or additional information from Users and/or Domestic Helpers
  • Enable Domestic Helpers to securely upload consent forms and requested documents only
  • Send confirmations, reminders, and system-generated status updates related to background check requests

We may engage third-party background check vendors, government databases, and authorised partners to deliver certain components of the Services where legally permitted.

As our Services continue to evolve, we reserve the right to modify, expand, suspend, or discontinue any aspect of the Services, including pricing, at our discretion and with or without prior notice, subject to applicable law.

Consent and Use of Background Check Results

Background check results are shared only with the User (Employer or Agent) who ordered and paid for the service, are not displayed publicly or on Domestic Helper profiles, and are used solely for the specific background check requested. All such results remain strictly confidential at all times.

Limitations of Our Services

By using the Site and Services, you expressly acknowledge and agree that:

• DomestaSafe is a background check platform only. We do not provide recruitment, placement, matchmaking, or employment agency services.
• We do not employ Domestic Helpers, nor do we act as an employer, agent, broker, contractor, or representative of any User.
• We guarantee that background check reports are generated accurately based strictly on:
  • The information and documents provided by the User and/or the Domestic Helper, and
  • Legally available official databases and authorised sources at the time of the background check
• We do not guarantee:
  • The accuracy, truthfulness, or completeness of any information or document submitted by Users or Domestic Helpers
  • That any individual is safe, trustworthy, suitable, or fit for employment
  • A background check report cannot predict future behaviour, conduct, or legal issues.
• Background check results:
  • Reflect only the records and information available at the time the background check is conducted
  • They are entirely dependent on the accuracy and completeness of the information provided by the User and the Domestic Helper
  • May be affected by:
    • Delays in official record updates
    • Jurisdictional reporting rules
    • Incorrect, false, misleading, forged, concealed, or incomplete information provided by the subject
  • Do not eliminate the risks associated with employment, engagement, or ongoing interaction with any individual
• Where any incorrect, false, or inconsistent information is identified, we will make reasonable efforts to contact the User and/or the Domestic Helper to obtain corrected or additional details. However, if accurate information is not provided despite such efforts, we shall not be responsible or liable for any resulting inaccuracies in the background check report.
• Users acknowledge that behaviour and personal circumstances may change over time, and an individual with a clean background check report at the time of issuance may later become involved in issues arising after the background check has been completed.
• Accordingly, we strongly recommend periodic checks of Domestic Helpers to:
  • Reduce long-term security risks
  • Detect changes in legal, civil, or financial status
  • Support safer, ongoing engagement decisions
• Background check reports are shared strictly for reference and decision-support purposes only. All hiring, engagement, and continued employment decisions are made solely at the User’s independent discretion and risk.
• We shall not be responsible or liable for:
  • Any act, omission, misconduct, crime, dispute, fraud, injury, or loss occurring after the background check has been completed
  • Any decision made by a User based on an outdated background check report, where a repeat background check was not conducted
  • Any reliance placed on a background check report as the sole basis for hiring or continued engagement
  • Any loss or damage arising from false, misleading, forged, concealed, or incomplete information provided by the User or the Domestic Helper
• We do not control or supervise:
  • The conduct of Employers or Domestic Helpers
  • Any employment relationship, including working hours, wages, benefits, accommodation, safety, termination, or statutory compliance
• We do not provide legal, financial, employment, medical, or immigration advice. Users must seek their own independent professional advice where required.

User Responsibilities

By using the Platform and Services, all Users expressly acknowledge and agree that they are solely responsible for their actions, decisions, and legal compliance.

General Responsibilities of All Users

By using the Platform, you agree that:

You are solely responsible for:

• The information you provide
• Any content you upload or submit
• Any decision you make based on information obtained through the Platform

You will comply with all applicable laws, including:

• Immigration and right-to-work laws
• Labour and employment laws
• Data protection and privacy laws
• Any sector-specific regulatory requirements

You are responsible for:

• Conducting your own interviews, reference checks, and additional due diligence as required
• Independently assessing the suitability of any Employer or Domestic Helper
• Ensuring that all contracts, salary, working hours, accommodation, benefits, and statutory obligations comply with local law

Responsibilities of Employers (Requesting Parties)

If you use the Platform as an Employer, you are solely responsible for:

Making all hiring, continuation, suspension, and termination decisions

• Determining role suitability, access levels, and associated risks for your household or premises
• Ensuring full compliance with all applicable labour, immigration, wage, safety, and employment laws

Verifying:

• The Domestic Helper’s identity and legal right to work
• Any relevant credentials, certificates, licences, or references

Ensuring that you:

• Do not unlawfully discriminate
• Comply with legal obligations relating to:
  • Employment contracts and wages
  • Rest days and working hours
  • Safety, welfare, and living conditions
  • Termination and repatriation (where applicable)

Responsibilities of Domestic Helpers (Background Check Subjects)

If you use the Platform as a Domestic Helper, you are solely responsible for:

• Providing true, accurate, complete, and current personal information strictly for the purpose of conducting the authorised background check services.
• Submit only genuine, valid, and lawful documents required for the applicable background checks.
• Ensuring that you are legally permitted to undergo background checks in the relevant jurisdiction.
• Not concealing, falsifying, or misrepresenting any information submitted for background checks.
• Cooperating promptly with any background check requests, clarification requirements, or document resubmissions.

Eligibility

By registering or using the Platform, you represent and warrant that:

• You are at least 13 years old (or the legal age of majority in your jurisdiction, if higher).
• You have the legal capacity and authority to enter into this Agreement.
• You are using the Platform for lawful purposes related to domestic helper hiring, not for any unlawful, abusive, or exploitative activity.

We may suspend or terminate your account if we believe you do not meet these criteria.

Accounts, Content, and Acceptable Use

Registration & Account Security

Only Users (Employers or Agents) are permitted to create an account on the Platform. Domestic Helpers are not allowed to create accounts and may only submit consent and required documents through the secure links or methods provided by DomestaSafe.

When you create an account on the Platform, you agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential and secure
• Be responsible for all activity that occurs under your account
• Notify DomestaSafe immediately if you suspect unauthorised access or misuse

We reserve the right to refuse, suspend, or cancel any username or account at our discretion.

User Content

“Content” means any information, documents, identification details, forms, or materials that a User or Domestic Helper submits through the Platform solely for the purpose of requesting or completing background checks.

What Users (Employers/Agents) May Submit

• Personal and contact information
• Background check requirements
• Details necessary to initiate a background check request

What Domestic Helpers May Submit

• Signed consent forms
• The requested documents are required exclusively to complete the authorised background check services.

No other uploads, such as photos, videos, chat messages, or public posts, are required or supported.

Prohibited Content

You agree not to upload, submit, or transmit any Content that:

• Is unlawful, defamatory, threatening, harassing, abusive, hateful, or discriminatory
• Infringes intellectual property, privacy, or data protection rights
• Is false, misleading, forged, altered, concealed, or deceptive
• Contains malware, viruses, or harmful code
• Promotes illegal activity, exploitation, or abuse

Confidentiality and Use of Submitted Content

All Content submitted to DomestaSafe:

• Is used solely to perform the requested background checks
• Is kept strictly confidential and secure
• Is not shared, sold, published, or reused for any unrelated purpose
• Is processed only as necessary to complete the background check initiated by the User
• Is stored and protected in accordance with our Privacy Policy

Important: We DO NOT use your Content for:

• Marketing
• Training (including AI training)
• Analytics
• Public display
• Any purpose unrelated to the background check

Licence to Use Content (Limited & Purpose-Bound)

You grant DomestaSafe a limited, non-exclusive, purpose-bound licence to use, store, and process your submitted Content only as necessary to perform the background check services you request and to comply with applicable legal, regulatory, and audit requirements.

This licence does not permit us to publish your Content, modify it for any unrelated purpose, distribute or commercially exploit it, or use it in any manner outside the background check process.

Content Moderation

We may refuse, remove, restrict, or block access to any Content that violates these Terms or appears unlawful, harmful, suspicious, or inappropriate. Such actions are taken solely for compliance and security purposes. We do not monitor or review Content beyond what is reasonably necessary to provide the background check services.

Fees, Payments & Refunds

Fees

All background check services offered by DomestaSafe are subject to the fees displayed at the time of purchase.

By placing an order, you agree to pay:

• All applicable Service fees
• Any associated taxes or charges
• Any additional fees required (if applicable)

All fees must be paid in full at the time of purchase.

Payment Processing

Payments are processed securely through authorised third-party providers. By completing a purchase, you authorise us and our payment partners to charge your selected payment method for the Services ordered.

Refund & Cancellation Policy

All fees are strictly non-refundable.

No cancellations, refunds, or credits will be issued once a purchase order has been submitted.

No changes to background check requirements, applicant details, or order information can be made after submission.

This applies even if:

• You no longer require the Service
• You submit incorrect or incomplete details
• The Domestic Helper withdraws, declines, or fails to cooperate
• You are dissatisfied with the results or outcome of the background check
• You terminate your account after purchasing a Service

Note: This policy applies because DomestaSafe’s automated systems and human processes begin immediately upon order submission, resulting in instant operational effort and resource allocation. Accordingly, refunds or cancellations cannot be accommodated under any circumstances.

Intellectual Property & Protection of Content

All content available on the Platform, including but not limited to text, graphics, logos, icons, page layouts, workflows, processes, software, design elements, reports, templates, and other materials (“DomestaSafe Content”), is the exclusive property of DomestaSafe.

You may not:

• Copy, reproduce, download, or distribute any DomestaSafe Content
• Modify, adapt, translate, or create derivative works
• Sell, license, or commercially exploit any part of the Platform
• Scrape, extract, harvest, or collect data, content, or platform structure
• Reverse-engineer or attempt to replicate any proprietary background check logic, user experience (UX) flows, or system features
• Use DomestaSafe Content for competitive or commercial purposes

Unless you have our prior written consent, no part of the Platform may be copied, used, reproduced, or distributed in any manner. All rights not expressly granted under these Terms are reserved.

Third-Party Links & Services

The Platform may contain links to third-party websites or services (such as payment gateways or information resources). We do not control, endorse, or assume responsibility for any third-party sites or services. Your access to or use of any third-party website or service is entirely at your own risk and subject to that third party’s terms, conditions, and privacy policies.

Disclaimers and Assumption of Risk

“As Is” Basis

The Platform and all Services provided by DomestaSafe are offered on an “as is” and “as available” basis.

To the maximum extent permitted by law, DomestaSafe disclaims all warranties, express or implied, including, without limitation:

• The accuracy, completeness, or reliability of any information submitted by Users or Domestic Helpers
• Merchantability, fitness for a particular purpose, or non-infringement
• Uninterrupted, secure, timely, or error-free access to the Platform
• That the Services will meet any User’s expectations, requirements, or intended outcomes

DomestaSafe makes no guarantee regarding the availability, accuracy, or performance of third-party systems, databases, or service providers relied upon during background checks.

No Guarantee of Outcomes

DomestaSafe does not guarantee or warrant that:

• A User will make a safe, suitable, or reliable hiring decision
• A Domestic Helper is trustworthy, risk-free, or suitable for employment
• Any check or report will prevent misconduct, harm, loss, or disputes
• A clear or adverse result reflects a person’s current or future behaviour

All hiring and engagement decisions are made solely at the User’s discretion and risk. DomestaSafe does not accept responsibility for any outcomes, events, or consequences arising from:

• A User’s reliance on background check reports
• A Domestic Helper’s actions or omissions
• Any employment relationship or interaction between Users and Domestic Helpers

By using the Platform, you acknowledge that you assume full responsibility for your decisions, actions, and the risks associated with hiring or engaging any individual.

Limitation of Liability

To the fullest extent permitted by law:

We, including our directors, officers, employees, and agents, shall not be liable for any form of loss, damage, cost, or claim arising out of or connected to the Platform or the Services, including but not limited to:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, income, data, goodwill, or reputation
• Personal injury, emotional distress, property damage, or financial loss
• Any misconduct, fraud, negligence, or unlawful behaviour by Domestic Helpers or Users

Background check reports are provided solely for informational and decision-support purposes. All hiring, engagement, supervision, and management decisions are made entirely at the User’s own discretion and risk.

No Compensation or Reimbursement: Users expressly acknowledge and agree that we make no representations or warranties regarding the safety, suitability, trustworthiness, conduct, or behaviour of any Domestic Helper. We shall not be liable for, and expressly disclaim, any responsibility for compensation, reimbursement, damages, losses, or financial claims of any kind arising from or related to any event, dispute, misconduct, or incident occurring before, during, or after the background check process. Users assume full responsibility and all associated risks when hiring or engaging a Domestic Helper, regardless of whether a background check report has been provided.

Overall Limitation: To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Platform, the Services, or these Terms shall be limited to the extent allowed by applicable law, and we shall not be obligated to pay or compensate Users under any circumstances. Where certain jurisdictions restrict liability limitations, the terms above shall apply to the maximum legal extent.

Indemnity

You agree to fully indemnify, defend, and hold harmless DomestaSafe, its affiliates, directors, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, penalties, costs, or expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Platform or Services
• Your breach of these Terms or any applicable law
• Any Content, documents, or information you submit
• Any relationship, communication, engagement, contract, or dispute between you and a Domestic Helper, Employer, Agent, or any third party
• Any action you take (or fail to take) based on background check reports or information obtained through the Platform

This indemnity applies regardless of the outcome of any hiring decision and covers all risks that arise from your interactions, decisions, or reliance on the Platform or the check results.

Termination

DomestaSafe may, at any time and without prior notice, suspend or terminate:

• Your access to the Platform, and/or
• Your account

If we believe that you have:

• Violated these Terms or any applicable law
• Misused the Platform or acted in a way that may harm DomestaSafe or any User
• Provided false, misleading, incomplete, or fraudulent information
• Engaged in behaviour that compromises system integrity, safety, or security

User-Initiated Termination

You may stop using the Platform or close your account at any time through your account settings or by contacting DomestaSafe.

Effect of Termination

Upon termination:

• Your right to access or use the Platform and Services immediately ceases
• Any pending or active background check orders remain non-refundable
• DomestaSafe may retain certain data as required by law or for legitimate business purposes (including fraud prevention, audit requirements, and dispute handling)

Termination does not limit our right to pursue any remedies available under law for prior violations.

Governing Law & Dispute Resolution

Unless otherwise required by mandatory local laws:

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict-of-law principles.

Informal Resolution First

• You and DomestaSafe agree to make reasonable efforts to resolve any dispute informally before initiating legal action.
• This may be done through email, video call, or any mutually agreed-upon communication method.

Jurisdiction for Legal Disputes

If a dispute cannot be resolved informally:

• The dispute shall be submitted to the exclusive jurisdiction of the courts of Hong Kong, and
• All Users agree that Hong Kong shall be the primary venue for resolving disputes involving DomestaSafe.

Users Located Outside Hong Kong

If the User resides in a different country, the dispute resolution process may be conducted online/remotely, unless a physical appearance is legally required.

This clause ensures that:

• Hong Kong remains the governing legal jurisdiction, and
• International Users are not required to travel to Hong Kong unless legally mandatory.

Electronic Communications

By using the Platform, you consent to receive electronic communications from DomestaSafe through email, WhatsApp, phone calls, and system notifications.

Users (Employers/Agents) may receive communications relating to account activity, payment confirmations, order status updates, check progress, requests for additional information, service updates, security alerts, and legal notices.

Domestic Helpers may receive communications necessary to complete the check process, including consent requests, document submission reminders, and status notifications. You agree that all such electronic communications satisfy any legal requirement that these communications be in writing and hold the same legal effect as physical written notices.

Changes to These Terms

We may update or modify these Terms from time to time. Updated Terms will always be posted on the Platform, and the most current version will apply each time you access or use the Services. Separate notifications may not be issued, and it is your responsibility to review the Terms whenever you visit the Platform. Continued use of the Platform after any changes take effect constitutes your acceptance of the updated Terms.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Failure to enforce any right or provision shall not constitute a waiver of that right or provision. You may not assign or transfer any of your rights or obligations under these Terms without DomestaSafe’s prior written consent.

We may assign or transfer our rights and obligations under these Terms, including in connection with any merger, acquisition, sale of assets, or corporate reorganisation.
